1. About TrustCaptain
TrustCaptain is a review platform that enables businesses to claim a verified profile (tied to their domain name), collect email-confirmed reviews from their customers, respond to those reviews publicly, and display a trust widget on their own website. Reviewers are members of the public who have had an experience with a listed business.
The Platform is operated by Artemis Labs Pte. Ltd., a company incorporated in Singapore with its registered office at 9 Raffles Place, #29-05, Republic Plaza, Singapore 048619.
2. Eligibility
To use the Platform you must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher). By using the Platform you represent and warrant that you meet this requirement.
If you are accessing the Platform on behalf of a company, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and “you” shall refer to both you and that entity.
We reserve the right to refuse access to the Platform to any person or entity at our sole discretion, including where we have reason to believe that applicable law prohibits us from providing services in a particular jurisdiction.
3. Accounts
3.1 Registration
Some features of the Platform require you to register for an account. You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Account security
You must notify us immediately at contact@trustcaptain.io if you become aware of any actual or suspected unauthorised use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
3.3 One account per domain
Each business domain may have only one verified business account on TrustCaptain. Creating multiple accounts for the same domain or attempting to circumvent this restriction is prohibited.
4. Business Profiles and Domain Verification
4.1 Claiming a profile
Businesses may claim a TrustCaptain profile by verifying ownership of their domain via the methods we provide (e.g. DNS record, file upload, or email confirmation). Successful verification grants you control over your business profile, including the ability to respond to reviews.
4.2 Accuracy of business information
You are responsible for ensuring that all information on your business profile is accurate, complete, and not misleading. We reserve the right to correct or remove inaccurate profile information.
4.3 Profile integrity
A business profile on TrustCaptain reflects genuine reviews from real customers. You must not use your business account to suppress, manipulate, or artificially inflate reviews, or to engage in any activity that undermines the integrity of the review system.
5. Reviews and User Content
5.1 Who may submit reviews
Any individual who has had a genuine first-hand experience with a business listed on TrustCaptain may submit a review. You must verify your email address before your review is published. Each email address may submit one review per business domain.
5.2 Review authenticity
All reviews must be honest, accurate, and based on your genuine personal experience. By submitting a review you represent and warrant that:
- You have had a real, first-hand experience with the business you are reviewing.
- The review reflects your genuine opinion and is not fabricated or exaggerated.
- You have not been offered any incentive (monetary or otherwise) in exchange for submitting a positive, negative, or specific review, unless you clearly disclose such an arrangement in the review text.
- You are not an employee, owner, officer, director, or close associate of the business you are reviewing, unless this relationship is clearly disclosed.
- You are not a competitor of the reviewed business submitting a review in bad faith.
5.3 Prohibited review content
Reviews must not contain:
- Defamatory, libellous, or maliciously false statements.
- Hate speech, harassment, threats, or discriminatory content on the basis of race, ethnicity, gender, religion, sexual orientation, disability, or any other characteristic.
- Obscene, explicit, or sexually inappropriate material.
- Private or confidential information about individuals without their consent (including names, contact details, or financial information).
- Content that infringes any third party’s intellectual property rights.
- Advertisements, promotional links, spam, or solicitations.
- Content unrelated to the reviewer’s genuine experience with the business.
- Content that promotes or facilitates illegal activity.
5.4 Business responses
Businesses may post one public response to each review. Responses must be professional, relevant, and comply with the content standards in Section 5.3. Responses must not reveal personal information about the reviewer.
5.5 Content licence
By submitting a review, response, or any other content to the Platform (“User Content”), you grant Artemis Labs Pte. Ltd. a worldwide, royalty-free, non-exclusive, sublicensable, transferable licence to use, reproduce, display, distribute, modify (for formatting purposes only), and create derivative works from your User Content in connection with operating and promoting the Platform.
You retain ownership of your User Content. You represent and warrant that you own or have the necessary rights to grant the above licence, and that your User Content does not violate any third-party rights or applicable law.
5.6 Content moderation
We reserve the right (but assume no obligation) to review, remove, or edit any User Content at our sole discretion, including content that we believe violates these Terms, applicable law, or that poses a risk to our Platform, users, or reputation. We may also suspend or terminate accounts associated with such content.
6. Embeddable Widget
We provide a JavaScript snippet (“Widget”) that businesses may embed on their own websites to display their TrustCaptain rating and review summary. By installing the Widget you agree to the following:
- You will not modify, reverse-engineer, or decompile the Widget code.
- You will not use the Widget in a way that misrepresents your rating, review count, or review content.
- We may update the Widget at any time. Continued use of the Widget after an update constitutes acceptance of the updated version.
- We may withdraw Widget access if we determine that your use violates these Terms or our platform integrity standards.
7. Prohibited Conduct
In addition to the specific prohibitions set out elsewhere in these Terms, you must not use the Platform to:
- Violate any applicable local, national, or international law or regulation.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Engage in any form of automated scraping, crawling, indexing, or data mining of the Platform without our prior written consent.
- Attempt to gain unauthorised access to any part of the Platform, other user accounts, or our underlying infrastructure.
- Introduce malware, viruses, trojans, or any other malicious code.
- Circumvent, disable, or otherwise interfere with security-related features of the Platform.
- Use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks.
- Solicit or harvest email addresses or other personal information from other users.
- Create fake reviewer accounts or orchestrate coordinated inauthentic review campaigns.
8. Intellectual Property
8.1 Our intellectual property
The Platform, including its design, source code, trademarks, logos, and all content created by us (excluding User Content), is the exclusive property of Artemis Labs Pte. Ltd. or its licensors and is protected by applicable intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform solely for its intended purposes in accordance with these Terms.
8.2 Feedback
If you provide us with feedback, suggestions, or ideas about the Platform, you grant us a perpetual, irrevocable, royalty-free right to use that feedback for any purpose without compensation to you.
8.3 Copyright complaints
If you believe that content on the Platform infringes your copyright, please send a written notice to contact@trustcaptain.io including: a description of the copyrighted work; the URL of the infringing content; your contact information; a statement of good faith belief; and your signature. We will investigate and, where appropriate, remove the infringing content.
9. Third-Party Services and Links
The Platform may display links to, or information about, third-party websites and services. Such links are provided for convenience only. We do not endorse and are not responsible for the content, practices, or policies of any third-party website or service. Your use of third-party services is at your own risk and governed by their respective terms.
10. Disclaimers
Platform provided “as is”. To the maximum extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Reviews reflect third-party opinions. Reviews published on the Platform are the opinions of individual users and do not represent the views of Artemis Labs Pte. Ltd.. We do not verify the accuracy of reviews beyond confirming reviewer email addresses. We are not liable for any reliance you place on reviews or other User Content.
No guarantee of availability. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We may suspend, modify, or discontinue any part of the Platform at any time without prior notice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Artemis Labs Pte. Ltd., its directors, employees, agents, and affiliates shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, or costs of procurement of substitute goods or services, arising from or related to your use of (or inability to use) the Platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Platform, regardless of the theory of liability, shall not exceed the greater of (a) SGD 100 or (b) the total fees you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Artemis Labs Pte. Ltd. and its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your infringement of any third-party right.
13. Suspension and Termination
13.1 Termination by you
You may stop using the Platform at any time. Business account holders may close their account by contacting us at contact@trustcaptain.io. Closure of a business account does not automatically remove published reviews.
13.2 Termination by us
We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, if we are required to do so by law, or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.
13.3 Effect of termination
Termination does not affect accrued rights or liabilities. Sections 5.5 (Content licence), 8, 10, 11, 12, 14, and 15 survive any termination of these Terms.
14. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of laws principles.
Subject to Section 15 (Dispute Resolution), you irrevocably submit to the exclusive jurisdiction of the courts of Singapore in relation to any legal proceedings arising out of or in connection with these Terms.
15. Dispute Resolution
We encourage you to contact us in the first instance to resolve any dispute informally. Please reach us at contact@trustcaptain.io.
If a dispute cannot be resolved informally within 30 days of notice being given, either party may refer the matter to mediation administered by the Singapore Mediation Centre (“SMC”) in accordance with the SMC’s Mediation Procedure in force at the date of the dispute. If mediation is unsuccessful, either party may then pursue legal proceedings in the courts of Singapore.
Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
16. General Provisions
16.1 Entire agreement
These Terms, together with our Privacy Policy and any other policies or notices incorporated by reference, constitute the entire agreement between you and Artemis Labs Pte. Ltd. with respect to the Platform and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16.3 No waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
16.5 Force majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, acts of government, power failures, internet disruptions, or pandemics.
17. Changes to These Terms
We may revise these Terms from time to time. Where changes are material, we will provide notice via email (to registered account holders) or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform before the effective date.
